2. Using this website
By using this website you agree to these terms. The content on this website is provided for general information about our services. We aim to keep it accurate and up to date, but we do not guarantee that it is complete or free from errors, and it may change without notice.
You must not misuse this website, including by attempting to gain unauthorised access, introducing malicious code or using it in any way that is unlawful or that could damage or impair it.
3. Quotations and packages
- Prices on our Pricing page are starting packages for the defined scopes of work listed. All prices are shown in GBP (£).
- Custom software, complex web applications, integrations and larger websites are priced separately after we review your requirements.
- A quotation sets out the agreed scope, price and any payment terms. Work outside the agreed scope will be discussed and quoted before it is carried out.
- Quotations are valid for 30 days unless stated otherwise.
4. Our responsibilities
We will carry out services with reasonable care and skill, communicate clearly throughout the project and deliver the work described in the agreed scope.
5. Your responsibilities
To help us deliver your project, you agree to:
- provide accurate requirements, content, materials and feedback in good time;
- ensure you have the right to use any content, images, logos or materials you give us; and
- provide any access (for example to hosting, domains or third-party accounts) reasonably needed for the work.
Delays in receiving information or feedback may affect timescales.
6. Payment
Payment terms, including any deposit, are set out in your quotation or invoice. Unless agreed otherwise, invoices are payable within 14 days. We may pause work if payments are overdue.
7. Intellectual property
Unless agreed otherwise in writing, once full payment has been received, ownership of the bespoke work we create specifically for you transfers to you. Third-party software, open-source components, fonts, plugins and services remain subject to their own licences. We may retain and reuse general tools, techniques and code that are not specific to your project.
All content on this website, including text, design and graphics, belongs to FANI SOFT LTD unless stated otherwise and may not be copied without permission.
8. Third-party services
Projects may rely on third-party services such as hosting providers, domain registrars, payment providers and APIs. These are provided under the third party’s own terms, and we are not responsible for their availability, pricing or changes.
9. Limitation of liability
Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be limited or excluded by law.
Subject to that, we are not liable for any indirect or consequential loss, or for loss of profits, revenue, data or business opportunity. Our total liability in connection with any project is limited to the amount paid to us for that project.
If you are a consumer, you have legal rights in relation to services that are not carried out with reasonable care and skill. Nothing in these terms affects those statutory rights.
10. Cancellation
Either party may end a project by giving written notice. You will be asked to pay for work completed up to the date of cancellation. If you are a consumer, you may also have a right to cancel within 14 days under the Consumer Contracts Regulations; if you ask us to start work within that period, you may need to pay for services provided before you cancel.
11. Privacy
We use personal information in line with our Privacy Policy.
12. Changes to these terms
We may update these terms from time to time. The version in force when you accept a quotation applies to that project.
13. Governing law
These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction over any disputes.
